1. About us

This website at dynamomediasolutionsltd.com (the “Site”) is operated by Dynamo Media Solutions LTD, 5 Purbrock Avenue, Watford, England WD25 0AD (“Dynamo Media Solutions”, “we”, “us” or “our”).

You can contact us at: support@dynamomediasolutionsltd.com.

2. Using this Site

By accessing or using the Site, you agree to these Terms & Conditions (“Terms”). If you do not agree with these Terms, you should not use the Site.

We may update these Terms from time to time by posting a new version on the Site. Your continued use of the Site following any changes means that you accept the updated Terms.

3. Our services

The Site describes marketing and media-related services that we may provide to organisations. The information on the Site is for general information only and does not, by itself, create a contractual relationship.

Any specific services, scopes, deliverables, timelines and fees will normally be set out in a separate proposal, order form, or statement of work (“SOW”). If there is a conflict between these Terms and an SOW, the SOW will take priority for that particular project.

4. Fees and payment

Where we agree to provide services, applicable fees, invoicing, and payment terms will be set out in the relevant SOW or contract. Unless stated otherwise, fees are usually exclusive of VAT and other applicable taxes.

5. Your responsibilities

Where we work with you or your organisation, you are responsible for:

6. Intellectual property

We retain ownership of all intellectual property rights in our pre-existing materials, tools, processes and know-how.

Unless otherwise agreed in an SOW, you receive a non-exclusive licence to use final deliverables created by us for your internal business purposes, once all applicable fees have been paid.

7. Confidentiality

Both you and we agree to keep each other’s confidential information secure and to use it only as needed to perform or receive the services, except where disclosure is required by law or by a regulator.

8. Data protection

We will handle personal data in line with applicable data protection laws and our Privacy Policy. You are responsible for ensuring you have a lawful basis to share any personal data with us.

9. No financial, legal, or gambling advice

The Site and our general information do not constitute financial, investment, legal, or gambling advice. We do not operate gambling services or financial products.

Any decisions you make about budgets, campaigns or other matters remain your own responsibility, and you should obtain independent professional advice where appropriate.

10. Disclaimers

The Site is provided on an “as is” and “as available” basis. While we aim to keep information accurate and up to date, we do not guarantee that the Site will be error-free, uninterrupted, or suitable for your particular circumstances.

We do not guarantee specific outcomes or returns from any media or marketing activity. Past performance is not a reliable indicator of future results.

11. Limitation of liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be limited or excluded.

Subject to the above, we will not be liable for any indirect, consequential, or purely economic loss, such as loss of profit, revenue, opportunity or data arising in connection with the Site or our services.

To the extent permitted by law, and unless otherwise agreed in an SOW, our total aggregate liability for any claims relating to the Site and any services will be limited to the fees paid to us by you in the three (3) months before the event giving rise to the claim.

12. Third-party links

The Site may contain links to third-party websites or services. We are not responsible for the content, security, or privacy practices of those external sites.

13. Suspension or changes to the Site

We may suspend, withdraw, or restrict the availability of all or any part of the Site for business or operational reasons, including maintenance or security.

14. Governing law

These Terms, and any dispute or claim arising out of or in connection with them, are governed by the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction, subject to any mandatory protections that apply under local law.
